Ukraine needs effective instruments to struggle against counterfeit products, – Tatiana Kharebava
Counterfeit products manufacturers, suppliers, and grey imports are key competitors of law-abiding players in the Ukrainian commodity and service market.
Tatiana Kharebava, a Counsel at Spenser and Kauffmann, Attorneys at Law, highlighted this problem during panel discussion as part of the II Ukrainian Antitrust Forum.
In her opinion, the main line of the AMCU’s activities, which is expected to improve the investment climate in the country, should include consideration and investigation of cases of products counterfeiting and illegal use of another’s goodwill and elements of recognition.
‘However, today Article 4 of the Law of Ukraine on Protection from Unfair Competition, which provides for the definition of illegal use of identification marks, is mainly of declarative nature because no effective mechanisms for its application are available for so far, – T. Kharebava stressed. – Thus, it is necessary to revise the rules of consideration of cases by the regulatory body, make changes to the relevant law to enforce and reinstate violated rights and implement effective mechanisms to bring to liability counterfeit products sellers.
